I just read the rule myself....
Between the clear wording of the rule & the written precedent by Greg that you posted, it's pretty cut & dry that he's not available to be picked up.
That said, I think it's a rule that should be revisited for next year.

My recollection of the rule was same as GG's, I was surprised to see Ely picked up in my league.
Emilio Bonifacio was another pickup in my league today that would seem to fall into the same category.
